Scope

These terms apply to all software and services provided by SEVTIX (Severin Schmid) (hereinafter «we»).
By downloading, installing, or using the software, you agree to these terms.

Our Service

We carefully develop and test our software on the vehicle platforms listed by us.
However, there is always a residual risk with any ECU modification.
If an error occurs that is demonstrably attributable to our software, we will work with you to find a solution.

Limits of Our Responsibility

ECU tuning deeply intervenes in vehicle systems, which are safety-relevant. An unexpectedly failing ECU can, in the worst case, lead to serious accidents.
You acknowledge that the use of modified ECU software constitutes an inherent risk, and you assume this risk fully and on your own responsibility.

The following points additionally lie outside our responsibility:

• The technical condition of your vehicle and ECU before, during, and after use.
• Effects on emissions, road registration, manufacturer warranty, or insurance coverage.
• Damage caused by improper use, differing vehicle configurations, third-party interventions, or failure to follow our instructions and guidelines.

Your Responsibility

By using any software modification, you confirm that you have an adequate technical understanding of ECU modifications and their risks, that you have fully backed up the original vehicle configuration before any modification, and that you independently comply with the laws and regulations applicable in your country.

All software modifications offered are without any CH or EU road approval. These modifications are intended only for use on closed tracks or practice grounds.
In most countries, an ECU modification voids the vehicle's road registration and/or insurance coverage.

Programming

During local or remote programming, a network interruption, power failure, loose connection, or similar issue can lead to permanent damage to the ECU. A guarantee for an error-free programming process is fundamentally not possible.
An ECU damaged by such circumstances will not be replaced free of charge unless a written agreement to the contrary exists. Depending on the situation, the ECU may be restored for a moderate fee.

Warranty

The software is provided without any express or implied warranty, in particular without any assurance of fitness for a particular purpose or compatibility with configurations not listed by us.
In the case of demonstrable or obvious defects in our software, you are entitled to rectification, provided no third-party interference can be identified.

Liability

Our liability for slight negligence is limited to the amount you paid for the affected software or service. Liability for indirect damages and consequential damages — including personal injury, property damage, and financial loss — is excluded in cases of slight negligence. This applies to both intended and unintended use.
Liability for wilful misconduct and gross negligence remains unrestricted (Art. 100 Para. 1 Swiss Code of Obligations).

Applicable Law and Jurisdiction

Swiss law applies.
The place of jurisdiction is Frauenfeld, to the extent permitted by law.

Changes

We reserve the right to modify these terms at any time. Significant changes will be communicated via our website.
Continued use after publication constitutes acceptance.

Agreements

Any deviating agreements require written form.
